1. Introduction & Acceptance of Terms
Welcome to Kraken Rack Monitor. These Terms & Conditions ("Terms") govern your use of:
The Kraken Rack Monitor device ("Device")
Our website at krakenrackmonitor.com ("Website")
Our mobile applications available on Apple App Store and Google Play Store ("App")
These services are provided by Pine Enterprises AB, a Swedish company located at Finalgatan 11B, 222 74 Lund, Sweden ("we," "our," or "us").
By purchasing our Device, using our Website, or downloading our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services or purchase our products.
2. Definitions
"Services" means the Device, Website, App, and all related services
"You" or "your" refers to the person or entity using our Services
"Device" means the Kraken Rack Monitor electronic sensor system
"Content" means any information, data, or materials on our Services
"User Content" means reviews, comments, or other content you submit through our Services
3. Eligibility & Account Registration
3.1 Age Requirement
You must be at least 16 years old to purchase and use our Services. If you are under 18, you represent that you have parental or guardian consent.
3.2 Geographic Restrictions
We currently ship the Device only to addresses within the United States. The App may be downloaded globally but requires the Device to function.
3.3 No Account Required
Our App operates entirely offline and does not require account creation or personal information collection.
4. Fees, Payments, and Refunds
4.1 Pricing
The Device is sold for a one-time payment. The App is free to download. There are no subscription fees or recurring charges.
4.2 Payment Processing
Payments are processed securely through Stripe. We accept major credit cards and Apple Pay. You agree to Stripe's terms of service for payment processing.
4.3 Return Policy
You may return the Device for any reason within 30 days of delivery, provided it is in original, unused condition with all original packaging and accessories.
4.4 Refund Process

You are responsible for return shipping costs
Upon receipt and inspection, we will refund the full purchase price (excluding original shipping costs)
Refunds are processed within 5-10 business days to your original payment method
4.5 EU Consumer Rights
If you are an EU resident, you have additional cancellation rights under EU consumer protection law, including a 14-day withdrawal period for distance purchases.
5. License Grant & Intellectual Property
5.1 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
Use the Device for personal, non-commercial purposes
Download and use the App on your mobile devices
Access and use the Website
5.2 Our Intellectual Property
The Device design, App, Website, and all related technology, trademarks, and content are owned by Pine Enterprises AB or our licensors. The Device is protected by pending U.S. patent applications.
5.3 Restrictions
You may not:
Reverse engineer, modify, or hack the Device or App
Remove any proprietary notices or labels
Use our intellectual property without written permission
Copy or distribute the App outside of official app stores
6. Acceptable Use
6.1 Proper Use
You agree to:
Use the Device only as intended for vacuum mount monitoring
Follow all installation and usage instructions in the provided manual
Use the Services in compliance with applicable laws
6.2 Prohibited Activities
You may not:
Use the Services for any illegal purpose
Interfere with or disrupt the Services
Attempt to gain unauthorized access to our systems
Use the Services in a way that could harm others or our business
7. User-Generated Content & REviews
7.1 Review Submission
You may submit reviews and feedback about the Device through our Website using Squarespace's review platform. By submitting User Content, you represent that:
The content is your own honest opinion based on your experience
You have actually purchased and used the Device
The content does not violate any laws or third-party rights
7.2 License to User Content
By submitting User Content, you grant Pine Enterprises AB a worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content for business purposes, including marketing and promotional materials.
7.3 Content Standards
User Content must not:
Be false, misleading, or fraudulent
Contain profanity, hate speech, or discriminatory language
Include personal information of others
Violate intellectual property rights
Contain spam or promotional content for competing products
Include content unrelated to the Device or your experience with it
7.4 Moderation Rights
We reserve the right to:
Review, edit, or remove User Content at our sole discretion
Refuse to publish reviews that violate these Terms
Remove reviews suspected of being fake or fraudulent
Contact you for clarification about your review
7.5 No Obligation
We have no obligation to monitor, edit, or remove User Content, but we may do so at our discretion.
7.6 Third-Party Platform
Reviews are hosted through Squarespace. Your use of Squarespace's review features is also subject to Squarespace's terms of service and privacy policy.
8. Third-Party Links & Services
Our Services may contain links to third-party websites or services (such as app stores). We are not responsible for the content, privacy practices, or terms of third-party services.
9. Term & Termination
9.1 Term
These Terms remain in effect until terminated by either party.
9.2 Termination by You
You may stop using our Services at any time. Your rights under our warranty and return policy survive termination.
9.3 Termination by Us
We may suspend or terminate your access to our Services if you violate these Terms, though this does not affect your ownership of purchased Devices.
9.4 Effect of Termination
Upon termination, your right to submit User Content ends, but previously submitted content may remain on our Website subject to our content license.
10. Warranty
10.1 Limited Warranty
We warrant that the Device will be free from manufacturing defects and will function as described for one (1) year from the date of delivery.
10.2 Warranty Coverage
The warranty covers:
Manufacturing defects
Damage from normal use, including exposure to rain during proper operation
10.3 Warranty Exclusions
The warranty does not cover:
Damage from misuse or failure to follow installation/usage instructions
Modifications or unauthorized repairs
Normal wear and tear beyond functional impact
Damage from accidents or extreme conditions
10.4 Warranty Claims
To claim warranty service:

You pay shipping costs to return the Device to us
We will repair or replace the Device at our discretion
We pay shipping costs to return the repaired/replacement Device to you
11. Disclaimers & No Warranty
11.1 Safety Disclaimer
IMPORTANT: The Device is a monitoring tool only. It is NOT a safety device and should NOT be relied upon to prevent accidents or ensure load security. Always use proper tie-downs and safety practices regardless of Device readings.
11.2 User Content Disclaimer
We do not endorse or verify User Content. Reviews and opinions expressed by users do not represent our views and should not be relied upon as professional advice.
11.3 General Disclaimers
EXCEPT FOR THE LIMITED WARRANTY ABOVE:
THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES
WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
THE APP AND WEBSITE ARE PROVIDED WITHOUT WARRANTY OF ANY KIND
12. Limitation of Liability
12.1 Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE DEVICE.
12.2 Excluded Damages
WE SHALL NOT BE LIABLE FOR:
INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES
DAMAGE TO CARGO, VEHICLES, OR OTHER PROPERTY
PERSONAL INJURY OR DEATH (EXCEPT WHERE PROHIBITED BY LAW)
DAMAGES RESULTING FROM DEVICE FAILURE OR MALFUNCTION
DAMAGES ARISING FROM USER CONTENT OR THIRD-PARTY CONTENT
12.3 Essential Terms
These limitations are essential elements of our agreement and apply even if remedies fail their essential purpose.

You agree to indemnify and hold harmless Pine Enterprises AB from any claims, damages, or expenses arising from:
Your use of the Services
Violation of these Terms
Your User Content
Violation of any rights of others
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms are governed by Swedish law, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes shall be resolved in the courts of Sweden. You consent to the jurisdiction of Swedish courts.
14.3 EU Consumer Protection
EU residents retain any mandatory consumer protection rights under applicable EU law.
15. Changes to the Terms
15.1 Updates
We may update these Terms from time to time. We will notify you of material changes by email (if provided) or by posting a notice on our Website at least 30 days before the changes take effect.
15.2 Continued Use
Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
